Debt Harassment and Your Rights

Behind the scenes, many people today are facing harassing phone calls, e-mails, and even people who show up on your doorstep. While you can feel helpless when this all happens, you still do have legal rights, and you should know them.
They can only contact you at certain times
Did you know that debt collectors can only contact you at certain parts of the day? A debt collector can’t call you at all times of the time. in fact, they are only usually allowed to call between the hours of 8AM and 9PM. If you get contacted at work, let them know that you want this to stop because your employer doesn’t allow it. If they continue, you can legally go after the firm.
You can have them stop contacting
Yes, debt collectors can get out of hand, and it almost seems like they never stop. Instead of letting them harass you, you can legally write out a letter and/or tell them by telephone that you would like the harassment to stop. When you take this route, make sure that you keep a copy of this letter for your own records. Once they receive your notification, they will legally have to stop contacting you.
Get everything in writing
Some debt happens when you can’t control it, or sometimes it will happen if it’s by mistake. If you think your debt claim is by mistake, you can contact them to get everything in writing. This will allow you to look everything over when it comes down to getting things straight. Make sure you’re not paying a debt that you don’t owe.
Know exactly what they can’t do
There are things that are absolutely off limits when it comes to discussing your debts. These things will include:
- Swearing or harassing you verbally.
- Claiming they are someone they aren’t. (For example, a police officer, judge, etc.)
- Tell you that they are going to physically harm you.
- Not telling you who they are. (By law, they have to tell you their name and the company they work for.)
- Say that they are going to arrest you and throw you in jail.
- Say they will garnish your wages. (By law, this can happen, but you will have to appear in court first.)
If you find that the debt collection agency does any of this, you may find that you have the right to either file a complaint or sue. When it comes to debt and your rights, make sure you understand what they can and can’t do.
